This privacy policy (as amended from time to time) (“Privacy Policy”) explains how and for which purposes the American Academy of Orthopaedic Surgeons and the American Association of Orthopaedic Surgeons (together, “AAOS”, “We”, “Our” or “Us”) collect, use, share and safeguard Your Personal Information, including when You visit or use Our websites (such as www.aaos.org, www.ajrr.net, www.orthoinfo.org, www.orthoguidelines.org, www.americanspineregistry.org), mobile websites, and microsites, My Academy™, OrthoGuidelines™, membership and other mobile applications, social media profiles and any other digital services and platforms officially operated or used by the AAOS from time to time (collectively, all of the foregoing referred to as “Our Sites”), purchase Our products or services (Our “Products” or “Services”), attend an AAOS event or otherwise interact with Us. The terms “You” and “Your” refer to all individuals and/or entities, whether AAOS members or non-members, accessing Our Sites or using Our Products/Services for any reason.

Acknowledgement and Consent

By visiting Our Sites, attending Our events, or purchasing Our Products or Services, You acknowledge that You accept the terms, practices and policies described in this Privacy Policy (as updated from time to time), and You hereby consent that We may collect, use, and share Your information as described herein.

If You do not agree with Our policies and practices, Your choice is not to use Our Sites, attend Our events, or purchase Our Products or Services. Your use of Our Sites, attendance to Our events, and use of Our Products or Services are at all times subject to Our Terms of Use (available here, as updated from time to time (the “Terms”)), which is incorporated by reference herein. Any capitalized terms We use in this Privacy Policy without defining them have the definitions given to them in the Terms.

What Information Does This Privacy Policy Cover?

This Privacy Policy covers Our treatment of Your Personal Information. “Personal Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with a particular person such as, but not limited to, Your name, mailing address, email address, telephone number, I.P. address, cookie identifier, etc. Please see additional information below on the particular information We may collect.

If You are a resident of the European Economic Area (“EEA“), United Kingdom, or Switzerland, Personal Information as used in this Privacy Policy includes “personal data” as defined under the General Data Protection Regulation (“GDPR”).  Please see the section below entitled “European Residents” for information on the Our legal grounds for processing Your Personal Information and the rights You have under the GDPR.

To the extent permitted by applicable law, Personal Information as used in this Privacy Policy does not include Your Personal Information that has been deidentified, pseudonymized, anonymized, aggregated, and/or otherwise processed in such a way that the data can no longer be attributed to a specific individual (by reasonable means) without the use of additional information, and where such additional information is kept separate and under adequate security to prevent unauthorized re-identification of a specific individual such that one could not, using reasonable efforts, link such information back to a specific individual (collectively, all of the foregoing in this sentence being referred to as “De-Identified Personal Information”).

We may collect Personal Information from You through means other than Our Sites. This may include offline collection, such as if You attend an AAOS event, submit a paper application, make a payment by check, or call or visit Our office. It also may include emails, text messages, social media chats, web chats, or other electronic communications that You send to Us separate from Our Sites or by way of Our service providers. This Privacy Policy will apply to such information, unless specifically disclosed otherwise.

If, for example, You are applying for membership, or, if applicable, for employment, either via Our careers page (available here) or offline, We may obtain information from third parties about membership, licensing, accreditation, certification, professional, and/or employment as part of a background check, among other information, as part of the application process.

Individuals under the Age of 18

We do not knowingly collect, solicit or maintain Personal Information from anyone under the age of 18 or knowingly allow such persons to register for or use Our Products or Services. If You are under 18, please do not send any Personal Information about yourself (such as Your name, address, telephone number, or email address) to Us. In the event that We learn that We have collected Personal Information from a child under the age of 18, We will use commercially reasonable efforts to delete that information from Our database. Please contact Us if You have any concerns. Notwithstanding the foregoing, AAOS may collect data relating to children under the age of 18 in its clinical data registries to the extent permitted by, and subject to, applicable law.  .

Changes to Our Privacy Policy

We are constantly working to improve Our Sites and Products/Services, and We may need to change this Privacy Policy from time to time as well. Our current Privacy Policy will always be on Our Sites and any updates will be effective upon posting. You are responsible for periodically checking Our Sites for updates. Under certain circumstances, We also may elect to notify registered users of changes or updates to this Privacy Policy by additional means, such as posting a notice on Our Sites or by sending You an email, but You should not rely on receiving such additional notice.

California Privacy Rights

In addition to the rights as explained in this Privacy Policy, under California’s "Shine the Light" law, California residents who provide Personal Information (as defined in the statute) to obtain AAOS products or services for personal, family, or household use are entitled to request and obtain from Us, once a calendar year, information about the Personal Information We shared, if any, with other businesses for marketing uses. If applicable, this information would include the categories of Personal Information and the names and addresses of those businesses with which We shared such Personal Information for the immediately prior calendar year (e.g., requests made in the current year will receive information about the prior year). To obtain this information, please write to Us at privacy@aaos.org and include Your full name and address and AAOS Member ID, if applicable.

Canada Anti-Spam Law

AAOS complies with the Canada Anti-Spam Law. Non-AAOS members who provide Us a Canadian email address will not receive unauthorized Commercial Electronic Messages (as defined under the Canada Anti-Spam Law) unless these individuals have “opted-in” to receive Commercial Electronic Messages.

International Transfers to U.S.

We are headquartered in the United States. The Personal Information We or Our service providers collect may be stored and processed in servers within or outside of the United States and wherever We and Our service providers have facilities around the globe, and certain information may be accessible by persons or companies outside of the United States who provide services for us.

We will take reasonable steps to ensure that Your Personal Information receives an adequate level of protection in the jurisdictions in which We process it.

If You are a resident of the EEA, United Kingdom, Switzerland, or other regions with laws governing data collection and use that may differ from the laws in the United States, please note that We may transfer Your Personal Information to a country or jurisdiction that does not have the same data protection laws as Your jurisdiction. To ensure that Your Personal Information is adequately protected when it is transferred, We have put in place appropriate safeguards that comply with applicable law on data transfers.

If You are a resident of a country other than the United States, You acknowledge and consent to Our collecting, transmitting, processing, transferring, and storing Your Personal Information out of the country in which You reside.

Tracking the Use of Our Sites

Our Sites use cookies and tracking tools that will recognize IP addresses, geographic location, digital device identifiers and browsers, which help Us analyze visitors’ practices and preferences. 

• Registered Site User - When You create an account to become a registered user on Our Sites or choose to interact with Us in other ways, You will be invited to submit certain Personal Information, which We collect in order to fulfill Your expectations and anticipate Your needs. Examples include applying for AAOS membership, registering for or attending an AAOS event, subscribing to AAOS publications, purchasing an AAOS Product, submitting a manuscript, participating in online surveys, searching for a job, submitting questions or comments on Our Sites, or requesting information or materials.
• Unregistered Site User - If You use Our Sites without becoming a registered user, You may anonymously browse the public areas of the Sites. Only aggregate data, such as the number of hits per page, is collected and may be used for internal and marketing purposes. No personally identifying information is obtained.

We comply with best practices developed by the U.S. Federal Trade Commission (FTC) which are available on the FTC website.

How We Use/Process Personal Information

We process Your Personal Information as needed to legitimately provide Our Products, Services, events, Sites and their functionality to You where we have a valid legal ground for doing so under applicable law, including but not limited to the following purposes:

• My AAOS Records – To verify and update Your current information.
• Membership - Process, fulfill and follow up on membership applications; and invite You to join AAOS or renew Your membership.
• Continuing Medical Education Credits - To allow You to claim CME credit with a certifying body, e.g. the American Board of Orthopaedic Surgery (ABOS) and the Accreditation Council for Continuing Medical Education (ACCME).
• Potential Conflicts of Interest – To populate Your disclosure information in the AAOS Orthopaedic Disclosure Database when required for You to participate in AAOS activities. The required information may include certain activities or financial interests that You or a family member have that may be perceived as a potential conflict of interest with Your AAOS activities.
• Donations to AAOS Orthopaedic PAC – To document PAC donations in compliance with Federal Election Commission regulations, We will ask for information about Your citizenship status, Your employer, Your occupation, and financial information, if applicable.
• Event Registration – To complete Your registration for the AAOS Annual Meeting, our courses and other events; and compile registration and physician attendee lists, including the AAOS member's name and address, to share with exhibitors in advance and/or after of the AAOS Annual Meeting, our courses or other events.  To share such information, we will rely on your consent, where required by applicable law, or our legitimate interests in promoting the AAOS Annual Meeting, our courses or other events.
• Annual Meeting Badges – To embed certain Personal Information in Annual Meeting badges (name, address, email address, telephone and practice focus) so that exhibitors may obtain registrant information through a lead retrieval system.
• Purchases – To complete Your purchase and delivery of AAOS Products and Services, including provide access to educational content, including CMEs, examinations/assessments, videos, journals and textbooks.
• Electronic Marketing Campaigns - To notify You about new Products/Services, special offers and other related information from AAOS, Our partners and approved third parties. We will rely on your consent for such processing, where required by applicable law, or our legitimate interests in promoting the promoting Our Products/Services.
• Find an Orthopaedist – If You elect to participate in the Find an Orthopaedist directory, the public will have access to a limited amount of Your information (name, address, telephone number and web address); and AAOS members will have access to additional Personal Information (email address, fax number, member classification and fellowship year).
• AAOS Activities – In addition to Personal Information in the AAOS Orthopaedic Disclosure Program, You will be identified as a member or a participant in various AAOS activities in a committee roster format that is accessible by AAOS members.
• Educational Submissions - Review Your manuscript, articles and abstract submissions.
• Hotel Reservations - Send the minimum required information to hotels to secure Your housing for AAOS meetings and events and/or to conduct audits for hotel room block calculations.
• Communications- Review and respond to Your emails or online requests, and communication through HNN, Advocacy Now, the Resident Newsletter, AAOS Now, and other communications.
• OITE test results - In accordance with the OITE Privacy Statement, Your identifying information and record(s) of use of in-training or practice materials, self-assessment exam collections, tests, and study tools, practice test results may be disclosed to Your residency program director and a third-party to evaluate learning outcomes and improve the effectiveness of these products. Disclosure of Personal Information will be to Your program director, ABOS and/or its agents or contractors for the purpose of evaluating and improving the effectiveness of AAOS’s self-assessment tools, test preparation materials, and study aids. Additionally, AAOS may disclose your Personal Information for the purposes of institutional and/or legal investigation and action if AAOS suspects conduct inconsistent with the representations made in the OITE's Examinee Conduct/Confidentiality provisions.
• AAOS Apps - AAOS mobile apps use geographic data to enhance Your experience by providing direction and messaging for key events.

Other examples of how Personal Information is used include:

• Send surveys and process survey responses;
• Process a job application;
• Ensure Our Sites are relevant to Your needs;
• Present focused advertising that might interest You, including targeted and online behavioral advertising;
• Recommend AAOS content that suits You; and
• Alert You when new content is posted or released.

You can limit alerts, opt-out of some communications or unsubscribe from all future promotional emails through the AAOS Preference Center. All e-mail communications contain an “unsubscribe” option to discontinue the communication at any time. When We contract with vendors to deliver emails to You on Our behalf, they are contractually prohibited from using Your Personal Information for any other purpose.

With Whom We May Share Personal Information

AAOS may share Personal Information with Our business partners in order to provide them an opportunity to offer products or services that may be of interest to You, with your consent where required by applicable law. AAOS also occasionally engages other companies to provide some of the limited services outlined above, as well as consulting services, events management, authentication services, data modeling, session monitoring and website analytics, printing, website and systems hosting, and data storage. We only provide those companies with access to Personal Information if required to deliver the requested services. These companies are prohibited from using that information for any other purpose.

Disclosure to third parties — On occasion, AAOS may disclose Your Personal Information to a third party. Those circumstances include when:

• authorized by You;
• permitted under this Privacy Policy;
• required by statue or regulation;
• in the event that We are involved in a joint venture, collaboration, financing, sale, merger, reorganization, change of legal form, dissolution or similar event. In such circumstances, Your Personal Information may be shared on a temporary or permanent basis, and We do not guarantee that any entity receiving Your Personal Information in connection with one of these events will comply with all of the terms of this Privacy Policy following such event;
• in the good-faith belief that such action is necessary to:
• conform to legal requirements or comply with legal process served on the AAOS;
• protect and defend the rights or property of AAOS;
• protect the personal safety of AAOS personnel or members of the public in urgent circumstances;
• enforce the AAOS’s Privacy Policy, Code of Conduct or Terms of Use.

Disclosure related to the Annual Meeting

Annual Meeting registration lists, including the medical registrant’s name, postal mailing address, and phone number are available for sale to exhibitors in advance of and after the Annual Meeting. When registering for the Annual Meeting, medical registrants may choose to opt out of the distribution of their name, postal mailing address, and phone number.

Personal Information, including medical registrant’s name, postal mailing address, phone number, email address, hospital affiliation, and practice focus, is available to Annual Meeting exhibitors and service providers on site through a lead retrieval system. While registering for Annual Meeting, medical registrants may choose to opt out of the distribution of their Personal Information through the lead retrieval system.

AAOS, its third-party vendors or service providers may collect, store and use Personal Information to provide AAOS Products and Services or to improve the user experience at AAOS events and with AAOS Products and Services.

In addition to the disclosures identified above, Your Personal Information may be incorporated into an association management solution (AMS). AAOS may license data in its AMS to third parties under strict guidelines. The names and addresses of users in the AMS are made available only for communications that are germane to the practice of orthopaedic surgery or of interest to these users as consumers.

Information security - AAOS implements security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of Personal Information. We restrict access to Personal Information to only Our employees and business partners who may need to know that information in order to operate, develop or improve Our Products or Services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

How We Safeguard Personal Information

Site Security Features

TLS Technology and How You Benefit from It — AAOS has taken a number of steps to enhance the protection of Personal Information sent to or from AAOS over the Internet. We require that a secure session be established, using Transport Layer Security (TSL) technology. This is done any time You supply or access information in one of Our secure online areas.

User ID and Password — Many areas of Our Sites require the use of a user ID and password as an additional security measure that helps protect Your Personal Information. This security measure allows AAOS to verify who You are, thereby allowing You access to Your account information and preventing unauthorized access. When You have finished using the secure areas of AAOS’s Sites, make sure You always click on the "Log Out" link which appears on every secure page. When You click on the "Log Out" link, You will be given the option to end Your secure session. No further secure transactions can be conducted without re-entering Your user ID and password. You should be aware that browser software often "caches" a page as You look at it, meaning that some pages are saved in Your computer's temporary memory. Therefore, You may find that clicking on Your "Back" button shows You a saved version of a previously viewed page. Caching in no way affects the security of Your confidential user ID or password.

No Guarantee — Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Because there are several entities involved in the flow of data over the Internet, despite Our efforts, AAOS cannot guarantee or warrant the security of any Personal Information You transmit to Us, or to or from Our online Products or Services. Email messages sent to or from a Site may not be secure. Confidential information should not be sent by email or if You do so, the confidential content should be attached to the email message on an encrypted file or at least protected by a strong password which You will convey to Us via an alternative communication channel (not the same email account). Linking to Other Internet Sites

You should be aware that other Internet sites that link to Our Sites or to an AAOS email may contain privacy provisions that differ from those contained in this Privacy Policy. We don’t control those sites or the information they collect about You. To ensure Your privacy is protected, We recommend that You review the privacy statements of other Internet sites You visit.

How Long Do We Store Your Personal Information

We keep Your Personal Information only so long as We need it to provide the Products or Service You've requested of Us (including membership, meeting registration and attendance, publication subscription, etc.), to fulfill the purposes described in this Privacy Policy, or to comply with legal requirements. 

How We Protect Your Personal Information

We have appropriate (technical, organizational and human) security measures in place to prevent Personal Information from being accidentally lost, used or accessed in an unauthorized/unlawful way. We limit access to Your Personal Information to those who have a genuine business need to do so. Those processing Your Personal Information will do so only in an authorized manner and are subject to a duty of confidentiality.

We also have procedures in place to detect and address any suspected data security breach. We will notify You and any applicable governmental entity of a suspected data security breach where We are legally required to do so.

European Residents

The following section apply only if You are a resident of the UK, EEA, or Switzerland. For such residents, all processing of Your Personal Information is performed in accordance with privacy rights and regulations, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, known as the General Data Protection Regulation, and as that regulation forms part of the laws of the UK (collectively, the “GDPR”), and Our processing will take place in accordance with the GDPR. For purposes of the GDPR, We will be the “data controller” of Personal Information (referred to and defined in the GDPR (available here) as “Personal Data”) We collect through Our Sites, unless We collect such Personal Information on behalf of a “data controller” in which case We will be a “data processor.” This Privacy Policy does not apply to websites, applications or services that do not display or link to this Privacy Policy or that display or link to a different privacy policy. For the UK, EEA, and Switzerland residents only, to the extent any definition in this Privacy Policy conflicts with a definition under the GDPR, the GDPR definition shall apply.

We provide adequate protection for the transfer of Personal Information to countries outside of the UK, EEA, or Switzerland through one or more of the following methods:

• a series of intercompany agreements based on or incorporating the Standard Contractual Clauses and/or the UK International Data Transfer Agreement or UK addendum to the Standard Contractual Clauses;
• relying on the European Commission’s adequacy decisions about certain countries, as applicable;
• obtaining Your consent for data transfers from Europe to third countries, including the United States; or
• to the extent applicable, relying on derogations as set forth in GDPR Article 49 for the transfer and onward transfer of Personal Information to third countries, including the United States. Such derogations may include transferring Your Personal Information where necessary to perform a contract with you, with Your explicit consent or in a manner that does not outweigh Your rights and freedoms.

In some circumstances, if Your Personal Information is not processed and transferred, We will not be able to execute the contract with You or You will not have access to any or all the benefits and features associated with Your transaction.

We also may need to transfer Your information to other group companies or service providers in countries outside of Europe. This may happen if Our servers or suppliers and service providers are based outside the UK, EEA, or Switzerland, or if You use Our Products and/or Services while visiting countries outside these areas.

Our Legal Basis for Processing Personal Data (UK, EEA, and Swiss Visitors Only)

If You provide Your Personal Information to Us from the UK, EEA, or Switzerland, Our legal basis for collecting and using the Personal Data described above will depend on the Personal Information concerned and the specific context in which You provide it. However, We will normally collect Personal Information from You only where We need the Personal Information to provide our Products or perform Services for You for which You have contracted with Us, where the processing is in Our legitimate interests, where you have given Your consent or where We are legally required to do so. In some cases, We also may have a legal obligation to collect Personal Information from You or may otherwise need the Personal Information to protect Your vital interests or those of another person.

The collection and processing of Your Personal Information may be necessary for the purposes of Our legitimate interests. Such legitimate interest purposes may include:

• Fraud prevention;
• Ensuring network and information security;
• Indicating possible criminal acts or threats to public security, including enhancing protection of Our community against spam, harassment, intellectual property infringement, crime, and security risks of all kind, and enforcing legal claims, including investigation of potential violations of Our Terms of Use;
• When We are complying with legal obligations;
• Processing employee or visitor, member, attendee, or registrant data;
• Performing the function, Product or Service You requested from Us;
• Providing Our Products or Services and their functionality to You where such processing is necessary for the purposes of the legitimate interests pursued by Us or by Our service providers related to the Services;
• Direct marketing (with your consent where required by applicable data protection law);
• Processing your Personal Information as necessary for the relevant and appropriate relationship We have with You;
• Analytics, e.g., assess the number of visitors, page views, use of Our Sites, etc., to understand how Our Sites, Products and Services are being used, to optimize Our Sites and/or future communications, and to develop new Products, Services and Site features;
• Updating Your Personal Information and preferences;
• Offering and improving Our Sites, Products, and Services; and
• Enforcing legal claims, including investigation of potential violations of Our Terms.

Your Data Rights Under GDPR

If You are subject to the GDPR, Your rights include the following:

• The right to access - Upon request, We will confirm any processing of Your Personal Information and provide You with a copy of that Personal Information in an acceptable machine-readable format.
• The right to rectification - You have the right to have Us correct any inaccurate Personal Information or to have Us complete any incomplete Personal Information.
• The right to erasure - You may ask Us to delete or remove Your Personal Information and We will do so in some circumstances, such as where We no longer need it (We may not delete Your data when other interests outweigh Your right to deletion).
• The right to restrict processing - You have the right to ask Us to suppress the processing of Your Personal Information but We may still store Your Personal Information.
• The right to object to processing - You have the right to object to Your Personal Information being used in the following manners: (a) processing based on legitimate interests or the performance of a task in the public interest/exercise of official authority (including profiling); (b) direct marketing (including profiling); and (c) processing for purposes of scientific/historical research and statistics.
• The right to data portability - You have the right to obtain Your Personal Information from Us that You consented to give Us or that is necessary to perform fulfillment of member benefits with You. We will give You Your Personal Information in a structured, commonly used and machine-readable format.
• Rights regarding automated decision making. You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning You or similarly significantly affects you, except for the exceptions applicable under relevant data protection laws.
